Welcome to the B380 smart camera and video doorbell management service!
This User Agreement (the "Agreement") is entered into between you and Ausek Limited, with its registered address at Building 4, Jianjin Bicycle (Shenzhen) Co., Ltd. Factory, South Side of Donghuan 2nd Road, Fukang Community, Longhua Street, Longhua District, Shenzhen ("Ausek," "we," "us," or "the Company"). This Agreement is legally binding. It consists of the main text of this Agreement and all rules that have been published or may be published by the B380 App. All such rules are an integral part of this Agreement and have the same legal effect as the main text.
Before accepting this Agreement, please read all of its terms carefully and fully understand them, especially the limitation and disclaimer clauses. Clauses limiting or excluding liability will be presented in bold or another conspicuous form. If you have any questions about this Agreement, please contact us through the channels listed in Section 12. You are not authorized to use the Service unless you have read and accepted all terms of this Agreement.
By selecting "Agree and Submit" and completing registration, or by using the B380 App and related services (the "Service") in any manner, you are deemed to have read and agreed to be bound by this Agreement.
If you breach any term of this Agreement, we may, in our sole discretion, restrict, suspend, or terminate the Service to you, and may pursue liability as permitted by law.
I. Definitions
1.1 B380 App (Licensed Software): the software system provided by Ausek for you to download, install, and use on iOS / Android mobile devices to manage Ausek's B380 series hardware devices such as smart cameras and video doorbells.
1.2 Service: the services provided to you by Ausek and its suppliers, including but not limited to device pairing, live video preview and playback, two-way talk, push notifications, and video doorbell calls. You may use these services through the B380 App on a mobile device.
1.3 Smart Device: hardware products manufactured by Ausek or its ecosystem partners that can connect to the B380 backend, including but not limited to smart cameras (IP cameras, IPC) and smart video doorbells.
1.4 Device Owner: the account holder who first adds a device to the B380 App and has full management rights over the device, including viewing, sharing, and deleting it.
1.5 Shared User: an account holder authorized by the Device Owner to add a device through a sharing QR code or sharing link. The scope of the Shared User's permissions is determined by the Device Owner.
II. Service Scope and License
2.1 Subject to this Agreement, Ausek grants you a personal, non-transferable, and non-exclusive right to use the B380 App.
2.2 You may not license, sell, rent, transfer, distribute, or otherwise use the B380 App for commercial purposes.
2.3 Due to platform and device compatibility limitations, you may only use the B380 App on authorized operating systems (iOS / Android) and devices. Installing the software on unauthorized devices may damage your hardware or software.
2.4 The B380 App is intended only for personal, non-commercial use. If you require commercial use, please contact us separately for authorization.
2.5 We may from time to time upgrade, modify, or transfer the B380 App and its related features, and may introduce new features or services. Unless a new feature or service has its own terms, this Agreement applies. Before launching a new feature involving data collection, we will notify you through an in-app pop-up and obtain your consent.
2.6 You are responsible for the accuracy, reliability, completeness, and legality of the data you enter and transmit through the B380 App, and you should back up important data regularly. You bear all risks arising from damage to or loss of such data.
2.7 You must keep your account and password secure. If you discover any security risk, including but not limited to password disclosure or device loss, you must notify us promptly. You are responsible for all activities under your account before you notify us.
III. Device Sharing and Permission Management
3.1 A Device Owner may share a device with family members or trusted contacts by generating a sharing QR code or sharing link. The sharing credential contains the device identifier, permission parameters, validity period, and verification code, and becomes invalid after expiration or revocation.
3.2 Device sharing permissions are divided into two levels:
- Full control: the Shared User has the same operating permissions as the Device Owner, including viewing live video, playing back recordings, using two-way talk, and changing device settings. Grant this permission with caution.
- View-only: the Shared User may only view live video and use two-way talk, and may not modify device settings.
3.3 The Device Owner may revoke sharing, change the sharing permission level, or extend the validity period at any time through the device sharing page.
3.4 A Shared User must keep the device access obtained through sharing confidential and may not disclose the sharing QR code, sharing link, or access permissions to any third party. If unauthorized access results from the Shared User's disclosure, the Shared User will bear corresponding liability.
3.5 A Shared User may not capture screenshots, record screen content, distribute, or use video or audio obtained through sharing for any purpose not authorized by the Device Owner.
IV. Special Terms for Video and Audio Data
4.1 Nature of Data
The B380 App is an IPC (IP Camera) management tool used together with cameras and doorbells. Use of the Service involves the collection, transmission, and storage of video and audio data. To protect your privacy and data security, we make the following commitments and agreements.
4.2 Data Transmission
- Live video: by default, live video is transmitted through a P2P (peer-to-peer) end-to-end direct connection and does not pass through Ausek's servers. We cannot view your live video.
- Two-way talk: audio is transmitted through a P2P direct connection and is collected and transmitted only while you press and hold the Talk button.
- Event snapshots or short clips: these are automatically uploaded only when a motion detection, doorbell call, or other alert event you have enabled is triggered, for the purpose of push notifications.
4.3 Data Storage
- SD card local recordings: stored entirely on the device's local SD card. Ausek cannot access, obtain, or view them.
- Event alert snapshots: automatically uploaded only when an alert event you have enabled is triggered, for the purpose of push notifications.
4.4 What We Will Not Do
- We will not view or monitor your live video or SD card recordings in real time.
- We will not use your video or audio data to train artificial intelligence models.
- We will not sell your video or audio data to third parties.
- We will not use your video or audio data for advertising or personalized recommendations without your explicit consent.
- We will not remotely turn on the camera or microphone without your knowledge.
4.5 Your Responsibilities
As a Device Owner or user, you agree:
- Not to install cameras in private places such as hotel rooms, bathrooms, changing rooms, or medical examination rooms;
- If a camera is installed in a home environment and its field of view includes domestic workers such as nannies or cleaners, to clearly inform them and obtain consent before the service begins;
- Not to point a camera at a neighbor's private space, such as windows or yards, in a way that infringes on their privacy;
- Not to use images captured by the device for harassment, stalking, extortion, or other illegal activities;
- If a camera is installed in a public or semi-public area such as a shop or office, to post clear monitoring notices as required by law.
You understand and agree that, as the user of the device, you are the data controller of the video and audio data collected by it. You are fully legally responsible for what your camera records and how that content is used. Ausek acts as a technical service provider and processes such data only to the extent necessary to provide the Service.
If you violate the above commitments, we may immediately terminate your account and cooperate with law enforcement.
V. Third-Party Services
5.1 You acknowledge that some functions of the B380 App may rely on software or services provided by third parties, including but not limited to push notification services, advertising attribution, and payment services. These services are provided for your convenience and are authorized by the relevant third parties. Some third-party services may cause your data to be stored or processed overseas. For details on cross-border data transfers, please refer to the relevant sections of the B380 App Privacy Policy.
5.2 The App contains some information and services provided by third parties. Ausek does not control such third-party information and services. When using third-party services, you may need to accept the terms of service and privacy policies of those third parties.
5.3 You understand that Ausek cannot guarantee that the App will permanently use or include such third-party services, or that it will continue to use the same third-party software or services in the future. Ausek may use similar services from other third parties. Once the relevant software or service is enabled, this section applies equally.
VI. User Conduct
6.1 When using the Service, you must not:
- Publish or distribute computer viruses, worms, malicious code, or software designed to damage or alter computer systems or data;
- Collect other users' information or data, such as email addresses, without authorization;
- Maliciously use the Service through automated means, overload servers, or otherwise interfere with or damage servers and network links;
- Attempt to access server data or communication data of the Service without authorization;
- Interfere with or disrupt the normal use of the Service by other users;
- Upload or distribute information containing the following:
- Content that violates the basic principles established by the constitution;
- Content that endangers national security, discloses state secrets, subverts state power, or undermines national unity;
- Content that damages national honor or interests;
- Content that incites ethnic hatred or discrimination or undermines ethnic unity;
- Content that undermines national religious policies or promotes cults and feudal superstition;
- Content that spreads rumors, disrupts social order, or undermines social stability;
- Content that spreads obscenity, pornography, gambling, violence, murder, terrorism, or incitement to crime;
- Content that insults or defames others or infringes on the lawful rights of others;
- Content that is false, fraudulent, harmful, coercive, invasive of privacy, harassing, defamatory, vulgar, obscene, or otherwise morally objectionable;
- Content restricted or prohibited by applicable laws, regulations, rules, or other binding norms.
- Engage in illegal surveillance as described in Section 4.5, such as installing cameras in private places, monitoring others without notice, or pointing cameras at a neighbor's private space;
- Use the Service for illegal live streaming, distribution, or commercial resale of video or audio;
- Modify device firmware without authorization or interfere with the normal operation of the Service.
6.2 You understand and agree that:
- Ausek may determine whether you have violated the above rules and, based on such determination, suspend or terminate your license or take other restrictive measures permitted by this Agreement;
- Ausek may delete information you publish through the Licensed Software that is suspected to be illegal, infringing, or in breach of this Agreement;
- If your violation of the above rules causes damage to any third party, you shall independently bear legal liability in your own name and hold Ausek harmless from any resulting losses or costs, failing which Ausek may seek compensation from you;
- If you violate applicable law or this Agreement and cause any loss to Ausek or its suppliers, you shall compensate Ausek and its suppliers for the resulting losses and expenses.
6.3 Remedies
If you breach this Agreement or any other agreement with Ausek, we may restrict your rights, including but not limited to suspending or terminating part or all of the Service, and take other necessary measures under law.
VII. Intellectual Property
7.1 All intellectual property rights in the B380 App and related services, including but not limited to software code, UI design, icons, copy, and technical solutions, belong to the Company or its licensors. Without prior written permission, you may not copy, modify, decompile, reverse engineer, publish, or otherwise use them.
7.2 You own the copyright in video recordings, screenshots, and other content created by you during use of the Service. You grant us a limited license to use such content when necessary to provide the Service, such as attaching thumbnails to push notifications or responding to your customer service requests. This limited license is limited to the scope and period necessary to provide the Service.
VIII. Disclaimer
8.1 Auxiliary security nature. B380 products are home security auxiliary tools and do not constitute a professional security alarm system. Except as expressly required by law, Ausek will use reasonable efforts to ensure that the Licensed Software and related technology and information are secure, effective, accurate, and reliable. However, due to the limitations of current technology, we do not guarantee that all events can be detected and recorded; that push notifications will always arrive promptly; or that recordings will always be clear and identifiable, as these may be affected by network conditions, phone systems, push channels, lighting, weather, and device status.
8.2 Force majeure. Ausek is not liable for direct or indirect losses caused by force majeure, including but not limited to fire, flood, earthquake, typhoon, terrorist attack, epidemic, war, or government action.
8.3 Third-party causes. To the extent permitted by law, Ausek is not liable for direct or indirect losses caused by third parties, including but not limited to third-party service provider outages, carrier network interruptions, or hacker attacks.
8.4 Limitation of liability. To the maximum extent permitted by law, Ausek's total liability for any claim related to this Agreement or the Service shall not exceed the fees you actually paid to Ausek for the Service in the preceding 12 months, excluding hardware purchase costs. The foregoing limitation does not apply to personal injury or property damage caused by Ausek's intentional misconduct or gross negligence.
8.5 You are solely responsible for personal injury or incidental or indirect damages arising from or related to the following:
- Unauthorized use of the Licensed Software or alteration of your data by a third party;
- Your misunderstanding or misuse of the Licensed Software;
- Other losses related to the Licensed Software that are not caused by Ausek.
8.6 Any software derived from the B380 App that is not developed by Ausek or developed and officially released with Ausek's authorization is illegal. Downloading, installing, or using such software may create unforeseeable risks, and Ausek is not liable for any resulting legal liability or disputes. Ausek may suspend or terminate your license and/or all services.
8.7 The Licensed Software must be downloaded from official download platforms such as the Apple App Store, Google Play, or official domestic app stores. You must comply with the download platform, operating system, and device manufacturer's requirements and restrictions. If a third party determines that you have violated such requirements and asks Ausek to take action, Ausek may terminate your license at the third party's request.
IX. Account Cancellation
9.1 You may apply to cancel your account at any time in the App. Path: My > Settings > Account and Security > Cancel Account.
9.2 Cancellation process:
- After you submit a cancellation request, your account enters a 7-day cooling-off period. Logging in again during this period will automatically withdraw your cancellation request.
- After the cooling-off period expires, we will formally process the cancellation by deleting your personal information unless retention is required by law and unbinding all devices associated with your account.
- Recordings on the device's local SD card are not affected because they are stored on your device.
9.3 After cancellation, you will no longer be able to use that account to log in to the B380 App or access any data associated with the account. The device may be bound to a new account after unbinding.
X. Protection of Minors
10.1 The B380 App is not designed for minors. Its core functions involve video monitoring and two-way talk, which require the user to have full civil capacity to make lawful privacy decisions.
10.2 Under applicable law, you must reach the following minimum age to register for and use the Service:
- Users in Mainland China: 14 years old;
- Users in the United States: 13 years old (COPPA);
- Users in the EU/UK: 16 years old (GDPR).
10.3 If we discover that we have inadvertently collected personal information from a minor, such as through notification from a guardian or our own discovery, we will delete the relevant data immediately. If you are a guardian and discover such a situation, please contact us through the channels listed in Section 12.
XI. Changes and Notices
11.1 We may update this Agreement from time to time. Changes are divided into two categories:
- General changes, such as wording improvements or supplementary clauses that are not material: we will notify you through an in-app message or announcement. The updated terms will take effect 7 days after publication.
- Material changes, such as substantive changes to liability clauses or data use: we will notify you prominently through an in-app pop-up and obtain your explicit consent.
11.2 If you do not agree to the updated terms, you should stop using the Service before the changes take effect and may apply to cancel your account. Continuing to use the Service after the changes take effect will be deemed acceptance of the updated terms.

XIII. Governing Law and Dispute Resolution
13.1 The validity, interpretation, modification, performance, and dispute resolution of this Agreement are governed by the laws of the People's Republic of China. If no applicable law exists, general international commercial practices and/or industry practices shall apply.
13.2 Mainland China users: disputes arising from or related to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, either party may file a lawsuit with the competent people's court at the Company's domicile.
13.3 Overseas users: disputes arising from or related to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to the Singapore International Arbitration Centre (SIAC) for arbitration in accordance with its arbitration rules then in effect. The seat of arbitration shall be Singapore, and the language of arbitration shall be English. The arbitral award shall be final and binding on both parties.
13.4 If any provision of this Agreement is held invalid by a competent court or arbitration institution, the validity of the remaining provisions shall not be affected, and you and Ausek shall continue to perform the remaining provisions in good faith.
This User Agreement is provided in English for convenience. In the event of any discrepancy, the Chinese version shall prevail.
